My husband is being told that he needs to sign a 1 year less where we have been living, or the landlord will not prosses the check and will count it as late, until he signs. I dont know if this is lawful or not. We have never not payed our rent! We are having proublems with them doing with on the proptery as well. it has taken a month for them to come out with someone to fix the garbage disposil. They were to repaint the a room as well from water damage and havent done it...that was over 3 years ago! Just is making me made. G-d had told my husband we will be moving, soon...and now this....he not knowing if he should sign that less. Just thinking about where or what we could do?
On top of that, I have a feeling, he just doesnt like what is befor him!

Abba, Please make it clear to my hubby what he is do to. He hears, than doughts, hears than says this is so...but the outcome isnt lineing up. I want you will and believe there is to much here for this to be clear for him. Please make things clear! In Jesus name, amen!

Peacemaker, it sounds like the landlord is doing something illegal. Do you know your renter's rights in the state you live in? You should be able to get a copy from local real estate offices. Here, you have to pay the rent, and if the problems aren't being fixed, you can contact your local news station. We have seen where several people were being forced to live in housing that was sub-standard, and the landlord was fined. I will be praying for you.

in australia peace maker its diffrent you do sign a lease but when the lease runs out dont have to sign another lease

i have done this in the places i have rented we have what you call a tenants tribunal the tenants tribunal backs the renter but also gives adivice to land lords

when i rent a place i wil sign a 6 month or 12 month lease and when the lease ends i just continue renting the house i am in or unit as i have rented houses and units i have had no trouble and your land lord does not have the right to do this

also keep this in the back of your mind as its law hear in australia no land lord can come into his own property while its being rented if he wants to do work or check his property he has to contac the agent who is looking after his property first then the agent gives you say 2 weeks notice that the land lord wants to do some work or wants to check his property and it wil give you the date he wants to do this and the time he wil be arriving and they ask that some one is home

never alow an agent or land lord to go into your home or unit with out you being ther as agents looking after the land lords property have a spare key and so does the land lord

if i was your husband i would pull back and get on to a tenency tribunal first

That is the same here, in some of the states. I dont know about this one as of yet. last year he put it off about 5 month and they said nothing. wird, but they are doing it because there arent money coming in this area as it had been the last few years. But if they kick us out, even if we are paying, we are by the way, in full and on time. She is just using this as a thrait so try and force us into a years less, we dont want.

we are in the middle of plaining a possible move, and need to not be in a years leass when that time comes. She is just scared we well not stay, like others at here, moving away, because of the highcost of this area drives many away.

My hubby got 5 calls from her today, and she fineally set a plummer in to fix my garbage disposel that hasnt been working for a month, she wouldnt even return our calls to get that fix, until about 2 weeks later, we still dont have our room painted! Just angry here!!!

yes, I know that is fear of losing us as renters, so they come running with papers in hands trying to foce by this way is to sign again, funny thing is, we have a right not to, as well as have a right to go month by month, and yet she is doing this....nutty!

your land lord is breaching the law by doing this and can be in big trouble i would not sign the lease for another year i would put my foot down

is there like a department of fair trading were you live ?

the reason i am asking the department of fair trading will give you advice as well


also i had forgotten to mention what i have done if the agent or land lord has refused to do work keep records take pictures of the property when you first move in that way you cant loose your bond as real estate agants are very good at braking the law

hear in australia before you agree to rent the unit or house you are intrested by law the real estate agent or land lord has to give you a peace of paper its like a conditions report the conditions report wil have boxes on one side and you tick the boxes if the place is in ok condition like no holes in the walls or rip carpet or or damaged cupboards

the real estate agent has to clean the unit or house first before a tenant moves in and mow the lawns clean the windows steam clean the carpets wash the floors clean in the kitchen and in the bath room and in the toilet clean the toilet and the bath room and the sinks and the cupboards and the oven

if you notice that this has not been done leave the place in the condition you found it in other wise when your time is up and you give two or three weeks notice you wil not get your bond back peace maker

hear in australia this happens a fair bit peace maker especialy to young people and people from other countrys who cant speak english they wil take advantage of you

i always have a camerra with me and a friend and i get them to bring ther camerra and you go threw the place and take photos and you keep the photos you have taken and put these photos in a file

the real estate agent can not tell you to not take photos with the conditions report of the property you sign and the real estate agent wil sign it and give you a spare copy and you keep the copy you are given

i refused to pay rent for a month becaus the land lord refused ot fix the hot plates i had to buy a small electric stove that i would place on my bench near the fridge i rang the tenancy tribunal and told them that my land lord was refusing to fix the hot plates on my stove as it was an electric stove and the tenancy tribunal on my behalf contacted the agent and the land lord and told them if the work that has been requested has not been done on the property you wil be taken to court and the onbudsman wil be told


he acted very fast as this land lord was very dodgy he would buy old houses and would go over them with a new paint job get new carpet get a cleaner to clean the old houses then he would approach a real estate agent and would ask the agent to find the right tennant and collect the rent

you can also say make it hard for the land lord were you just dont pay rent for a year

i am a christian that does not mean i am to alow people to take advantage of me or become a door mat were i am walked over

i am doing this know with an old agent and i have gotten the onbudsman involved

be care full and dont let land lords or agents acting on the land lords behalf take advantage of you you have rights as a human being peace maker


just some help full tips for you and for your husband


i refused to clean the unit i moved from as it was left dirty i had to borrow some cleanning products from the company i was cleanning for and i got the vacuem cleanner and steam cleanner and buffer as the kitchen floor had black thick marks

the person that was renting the unit done the midnight run he was a drug dealer


tell your husband to stand his ground and tell him not to sign the lease

Sounds like they are moving out of fear....Saying this, it sounds like they won't plan on kicking you guys out either because they seem anixous to keep you guys as renters.

no, not really! this just addes to my struggles right now. I dont like so much unknowen around me. It is so much deep things, that has to do with others around me, I dont like feeling that there isnt much control in matters, that will keep my family safe. We havent caused any harm at all, here. The women is just being forceful, in blocking us into this house for another year, and my husband will not deal with her, either. making me very mad.

I took a set back last night remembering those dreams that G-d has been giving me....boy, dont much like that feeling that I need to listen to my own words and trust G-d more, you know...that part of being so right, that you dont much like being right! Hu...does that make seance at all!? I had an over welling feeling to go back and look at those, but I knew what I would find, and did find...

Eye opening, it isnt an easy thing to find that I need to look for my own good at what G-d said in the past, to show what I need to be doing and finding it even harder to do.

Trust! I know that G-d my Father is trusting, but it is those around me I have a hard time trusting. I find that sometimes that goes hand in hand. G-d knows all and sees all, knows just want to do to make this person back off, as well as to make my husband move, and it doesnt matter just how stubborn they might be...if pharos heart can be moved, so can those around me....no I just have to put this up where my eyes can see it, so as not to let the trash move me!

Property rental laws vary from state to state, but I don't think your land lord has the legal basis to force you into signing a least or threaten a late charge on your rent if your don't sign a lease when you have paid your rent.

However, he could raise rent prices without a signed lease in order to charge you month to month.

But, if he accepts your check for the rent he's recourse is to notify you that your next month rent will go up per a month to month basis. If you refuse to pay the rent increase his only recourse to enforce his position is to evict you. Otherwise, without a rental agreement his receipt of your rent check is implied acceptance to the terms of renting the place for the amount of the check.

In otherwords he has a choice to simply refuse your check and say "pay me this amount or get out," otherwise receiving you check is implied acceptance to the terms to the amount on the check.

For example, if I wrote a check for $1 for my rent, my land lord can refuse it and demand a greater amount of tell me to leave. But, if he accepts it he's basically accepting my payent of $1 for that month's rent. He can however come back and return the check to you and tell you to leave within a certain amount of time.

That is just it, it is my hubby that is to take care of that, not me. I guess it would be better to just not think about it. I just wish he would care more in areas he should and less in areas he should put off. He just has things backwords from time to time, and this is just one of them. He want to but them off, because their ways it to get one to sigh and 12 month less, and if it is less, you pay more. My hubby doesnt know why G-d wants him to move but than turns around and doesnt take care of things like this so He feels less blocked in.

I just dont get him at times, and need to leave it in G-ds hands. I have asked G-d because my husband asked me to about this, does he want us to move, or say, where to move, or buy the rent, and so on...but I get nothing. Just dreams that shows he will take care of us, and one on of the dreams we are to go west. well, something has come up and my hubby didnt much like that answer from me, because he feels we are to move south. I feel just blocked in and angry all the time, I guess, really because I am not heard anymore by him.
I dont say what he wants me to say.
